UNCITRAL (UN Commission on International Trade Law) has already discussed an international instrument (convention or model law) with regard to judicial sale of ships. The EU takes part in this debate through its Working Party on Civil Law Matters. The EU's interest is that a future instrument be in line with the acquis, i.e. not contrary to the law and interests of the EU. In this sense, the intention of the Croatian Presidency was to organise a workshop where the Member States of the EU would be given an opportunity to acquaint themselves in detail with UNCITRAL's dossier and discuss some elements of the proposal that are of significance for MS and the EU, since they were not given such an opportunity during the Finnish Presidency. Based on this workshop and some discussions in the Working Party on Civil Law Matters, the EU will be better prepared to take its position on the proposal during discussions in UNCITRAL.
